Representative Cases

Lodsys, LLC v. Brother International, et al., (Eastern District of Texas 2011). Representing plaintiff in patent infringement case.

The People of the State of California Ex. Rel. Michael Strathmann v. Acacia Research Corporation, et al. (Orange County Superior Court 2010-2011). Prosecuting qui tam insurance fraud action.

Aventa Learning, Inc., et al. v. K-12, Inc., et al. (Western District of Washington 2010-2011). Representing plaintiffs in securities fraud lawsuit. Click here for copy of Order Denying Defendants’ Motion To Dismiss Amended Complaint.

In re Cellcyte Genetics Corporation Securities Litigation (Western District of Washington 2009). Defended former founder and CEO of biotech company in federal securities fraud class action. Negotiated dismissal of all claims without any payment to plaintiffs.

Strobele v. SNSC Realty Advisors, Inc., et al. (King County Superior Court 2008). Represented Strobele, an individual, against claims for partnership and accounting for over $500,000. Resulted in dismissal of all claims against Strobele after a week of trial.

Bucknuts, LLC v. Scout Media, Inc. (Western District of Washington, Southern District of Ohio, and American Arbitration Association 2007-2008). Defended Fox Interactive Media, Inc., Scout Media, Inc. and individual defendants in putative class action and individual actions in multiple jurisdictions alleging securities, RICO, and consumer protection act claims.

Dobyns v. Trauter (Western District of Washington 2007-2008). Defended company against breach of fiduciary duty, conspiracy, securities fraud, and shareholder oppression claims. Obtained dismissal of all claims on Rule 12(b)(6) motion.

United States Olympic Committee v. Organizing Committee for the Games of the Pacific Rim d/b/a Seattle Organizing Committee (Private Arbitration 2007). Represented the Seattle Organizing Committee against the United States Olympic Committee for the failed 2005 Pacific Sports Summit and obtained an arbitration award against the United States Olympic Committee for more than $3 million.

Enron Power Marketing, Inc. v. Public Utility District No. 1 of Snohomish County (Southern District of New York and Private Arbitration 2007). Represented Snohomish in multiple actions and negotiated settlement of Enron’s $180 million claim against Snohomish for $18 million.

Public Utility District No. 1 of Snohomish County v. Bonneville Power Administration (Ninth Circuit Court of Appeals 2007). Represented Snohomish in a multi-party proceeding challenging certain settlement agreements entered into by the BPA. Resulted in Ninth Circuit setting aside settlements involving hundreds of millions of dollars and remanding the case to BPA.

Clise v. Xypoint Corp. (King County Superior Court and Washington Court of Appeals, 2006-2007). Defended corporate and individual defendants against state securities act, fiduciary breach, and consumer protection act claims. Obtained dismissal of all claims on Rule 12(b)(6) motion and negotiated confidential settlement while on appeal.

Digeo, Inc. v. Audible, Inc. (Western District of Washington and Federal Circuit Court of Appeals 2006-2007). Defended Audible against patent infringement claims.

Plaza at Yarrow Bay, LLC v. Kirlin Management Co. (King County Superior Court 2006-2007). Defended tech-incubator tenant against landlord plaintiff’s $1 million claim for lease obligation. Resulted in landlord paying tech-incubator tenant.

Broadview Development Associates LP, et al. v. TKCC, Inc., et al. (King County Superior Court 2005). Represented Broadview in construction litigation. Resulted in settlement in favor of Broadview after two weeks of trial.

Good v. Evaline Community Association, et al. (Lewis County Superior Court 2005). Represented the Good entities against claims of multiple violations of RCW 4.24.510. Succeeded at trial in reducing the Evaline Community Association’s $12 million claim against Good to $10,000.

Enger v. Richards, et al. (King County Superior Court 2003-05) Defended individual in securities/RICO lawsuit arising from pricing of acquisition. Resulted in dismissal of all claims during trial.
